FOR ANY REASON, CUSTOMERS CAN RETURN THE ORDER, ENTIRELY OR PARTIALLY. PALMANGELS.COM REFUNDS WITHIN 14 DAYS FROM THE RECEIPT OF THE MERCHANDISE (EXCLUDES CERTAIN BEAUTY PRODUCTS CONTAINING HAZARDOUS OR FLAMMABLE MATERIALS, LIKE FRAGRANCES AND AEROSOLS).

THE RETURNED ITEMS MUST BE SENT BACK IN THEIR ORIGINAL PACKAGING TOGETHER WITH ALL THE MATERIALS RECEIVED WITH THE ITEM/S (DUST BAGS, COVERS ETC.) AND SHOULD HAVE A COPY OF THE INVOICE INSIDE.

THE ITEM/S MUST BE UNHARMED, UNWASHED, NOT WORN OR ALTERED AND MUST HAVE ALL ORIGINAL SECURITY SEALS STILL ATTACHED. WHEN TRYING ON SHOES, PLEASE BE MINDFUL NOT TO SCRATCH THE SOLES OR MARK THE SHOE BOX. BRIEFS, SWIMSUITS AND BIKINI BOTTOMS SHOULD BE TRIED ON OVER UNDERWEAR, WITHOUT REMOVING THE PROTECTIVE ADHESIVE STRIP OR THEY WILL NOT BE ACCEPTED. THIS IS FOR HYGIENE REASONS. WE WILL NOT ACCEPT ANY RETURNS THAT HAVE BEEN WORN OR ARE SOILED.

THE DPALM PACKAGING MUST NOT BE USED AS THE EXTERNAL PARCEL FOR THE SHIPMENT.

IF THE ITEM DOES NOT FIT THESE REQUIREMENTS THE ITEM WILL NOT BE ACCEPTED AND WILL BE SENT BACK TO THE CUSTOMER AT THEIR OWN COST.

PLEASE, BE AWARE THAT ALL “HOMEWARE” COLLECTION SETS MUST BE RETURNED AS A WHOLE AND THAT BED SETS ARE NOT RETURNABLE.

“HOMEWARE” CERAMICS ARE HANDCRAFTED. ANY IMPERFECTION CHARACTERIZES THE UNIQUENESS OF THESE PIECES, WHICH HAVE BEEN HAND MADE BY ARTISANS AND WILL NOT BE CONSIDERED DEFECTS. HOWEVER, PALMANGELS.COM WILL EXAMINE EACH QUERY CONCERNING POSSIBLE CERAMICS’ DEFECTS BEFORE ACCEPTING OR REFUSING THEM.

WE HAVE MADE EVERY EFFORT TO DISPLAY THE COLORS OF OUR PRODUCTS THAT APPEAR ON PALMANGELS.COM AS ACCURATELY AS POSSIBLE. HOWEVER, AS COMPUTER MONITORS, TABLETS AND MOBILE DEVICES VARY, WE CANNOT GUARANTEE THAT YOUR MONITOR'S DISPLAY OF A COLOR WILL BE COMPLETELY ACCURATE.


RETURNS POLICY

PLEASE REFER TO OUR RETURN POLICY WHICH FORMS AN INTEGRAL PART OF THESE TERMS AND CONDITIONS. 

RETURNED PRODUCTS MUST CONFORM TO OUR RETURNS POLICY BELOW. YOU HAVE A LEGAL OBLIGATION TO TAKE REASONABLE CARE OF THE PRODUCTS WHILE THEY ARE IN YOUR POSSESSION, AND YOU MUST RETURN THEM IN THE SAME CONDITION IN WHICH YOU RECEIVE THEM (EXCEPT TO THE EXTENT REASONABLY NECESSARY TO EXAMINE THEM).

IF YOU FAIL TO COMPLY WITH THE ABOVE OBLIGATIONS (INCLUDING THE CONDITIONS OF RETURN), WE MAY DEDUCT FROM THE REFUND AN AMOUNT TO REFLECT THE DIMINISHED VALUE OF THE PRODUCT(S) UP TO THE FULL PRICE OF THE PRODUCT(S). RETURNS AND REFUNDS FOR CUSTOMISED PRODUCTS
DUE TO THE NATURE OF PERSONALISED AND MONOGRAMMED PRODUCTS, RETURNS, CHANGES OR CANCELLATIONS ARE AT OUR DISCRETION. IN EXERCISING THIS DISCRETION, WE WILL HAVE REGARD TO THE LEVEL OF CUSTOMISATION AND PERSONALISATION AND ALSO RESERVE THE RIGHT TO OFFER A STORE CREDIT RATHER THAN A MONETARY REFUND. STORE CREDIT IS VALID FOR 6 MONTHS FROM THE DATE OF ISSUE. THIS DOES NOT AFFECT YOUR STATUTORY RIGHTS. PLEASE NOTE, THAT PERSONALISED AND/OR CUSTOMISED PRODUCTS MAY HAVE A LONG LEAD IN TIME BEFORE SHIPPING, BUT PAYMENT WILL BE TAKEN AT THE TIME OF OR SHORTLY AFTER YOU SUBMIT YOUR ORDER AND IN ADVANCE OF SHIPPING.

RETURNS AND REFUNDS FOR JEWELLERY

RETURN PROCESS
WE RECOMMEND THAT YOU RETURN PRODUCTS IN THEIR ORIGINAL PACKAGING TO ENSURE THE NECESSARY PROTECTION WHEN IN TRANSIT.
INSTRUCTIONS FOR THE RETURN OF THE PRODUCT(S) WILL BE INCLUDED WITH THE DELIVERY PACKAGE.
WHEN CANCELLING A PURCHASE AND RETURNING PRODUCTS TO US YOU HAVE TWO OPTIONS AVAILABLE TO YOU:
1. DEPENDING ON WHERE YOU LIVE, EXERCISE YOUR RIGHT TO CANCEL UNDER THE CONSUMER CONTRACTS (INFORMATION, CANCELLATION AND ADDITIONAL CHARGES) REGULATIONS 2013 (CCRS). IF YOU CHOOSE THIS OPTION YOU WILL BE REFUNDED THE FULL PRICE FOR THE PRODUCT(S) (SUBJECT TO OUR RETURNS POLICY) AND THE COST OF STANDARD DELIVERY BUT WILL BE LIABLE FOR THE ORGANISATION AND COST OF RETURNING THE PRODUCT(S) TO US.
2. USE OUR FREE RETURNS SERVICE. IF YOU CHOOSE THIS OPTION YOU CAN RETURN THE PRODUCTS(S) FOR FREE AND WILL BE REFUNDED THE FULL PRICE FOR THE PRODUCT(S) (SUBJECT TO OUR RETURNS POLICY) BUT NOT THE DELIVERY CHARGES.  WE DESCRIBE THESE TWO OPTIONS IN MORE DETAIL BELOW.

IF YOU CANCEL A CONTRACT BETWEEN US WITHIN THE 14 DAY COOLING-OFF PERIOD (SEE ABOVE), WE WILL PROCESS THE REFUND DUE TO YOU AS SOON AS POSSIBLE AND, IN ANY CASE WITHIN 14 DAYS AFTER THE DAY ON WHICH WE RECEIVE THE PRODUCT(S) BACK OR (II) IF EARLIER, THE DAY ON WHICH WE RECEIVE EVIDENCE THAT YOU HAVE RETURNED THE PRODUCT(S) TO OUR RETURNS ADDRESS.
WE WILL REFUND THE PRICE OF THE PRODUCT(S) IN FULL (SUBJECT TO ANY DEDUCTION WE ARE ENTITLED TO MAKE DUE TO YOUR USE OF OR DAMAGE TO THE PRODUCT(S)), INCLUDING THE COST OF STANDARD DELIVERY. YOU HAVE 14 DAYS FROM RECEIVING YOUR ORDER TO RETURN THE PRODUCT TO US. WE STRONGLY RECOMMEND THAT YOU BOOK YOUR FREE RETURNS PICK-UP WITHIN 7 DAYS OF RECEIVING YOUR ORDER TO ENSURE THAT IT ARRIVES BACK IN TIME.

WHAT HAPPENS NEXT?
PRINT OUT THE AIR WAYBILL (AWB) AND ATTACH IT TO THE OUTSIDE OF THE PARCEL. THERE WILL ALSO BE A COPY TO GIVE TO THE COURIER. PLEASE SAVE A COPY OF THE AWB FOR YOUR RECORDS. YOU CAN USE THIS TO TRACK YOUR RETURN SHIPMENT.
IF YOU HAVE BEEN PROVIDED WITH A RETURNS INVOICE FOR CUSTOMS, PLEASE ENCLOSE ONE INSIDE THE PACKAGE AND ATTACH A SIGNED COPY ON THE OUTSIDE WITH THE AWB.
DO NOT SEAL YOUR PACKAGE UNTIL THE DRIVER HAS CHECKED THE CONTENTS.
PLEASE NOTE THAT YOU HAVE 30 DAYS TO CONTACT US UPON THE PICKUP OF YOUR RETURN TO ENSURE THAT WE HAVE ACKNOWLEDGED IT AND RECEIVED THE PRODUCT. IF YOU CONTACT US AFTER THIS 30 DAYS PERIOD, WE CANNOT GUARANTEE A REFUND.

THE EXCHANGE OF PURCHASED PRODUCTS IS NOT ALLOWED. THEREFORE, PRODUCTS RECEIVED AFTER PURCHASE MAY ONLY BE RETURNED AND RESULT IN A REFUND OF THE PRICE PAID FOR THE PURCHASE UNDER THE CONDITIONS SET OUT IN THESE TERMS AND CONDITIONS.


TERMS AND CONDITIONS

GENERAL TERMS AND CONDITIONS OF SALE

1. Scope of Application

1.1 These General Terms and Conditions of Sale (the "General Terms and Conditions") apply to all sales contracts entered into between D-Palm, an Australian fashion brand, and the customer (the "Customer"). The General Terms and Conditions govern the sale of all "D-Palm" branded products (the "Products") via the e-commerce website www.dpalmtshirt.com (the "Website").

1.2 The Customer must read and accept these General Terms and Conditions before making any purchase. By accepting these terms, the Customer agrees to comply with them. If the Customer does not accept these terms, they may not purchase D-Palm products. It is recommended that the Customer print and save a copy of these General Terms and Conditions for future reference.

1.3 The General Terms and Conditions do not govern the provision of services or the sale of products by parties other than D-Palm, even if they are present on the Website through links, banners, or other hypertext links.

1.4 Purchasing products through the Website is strictly reserved for individuals who:

2. Conclusion of the Agreement

2.1 The sending of a purchase order by the Customer (the "Order") constitutes acceptance of the offer to the public made by D-Palm through the Website. The receipt of the Order by D-Palm constitutes the conclusion of a binding sales contract with respect to the selected products, governed by the General Terms and Conditions in force at the time of its conclusion (the "Agreement").

2.2 Before confirming and sending the Order, the Customer must check the summary to ensure that the selected products and all data provided are correct.

2.3 Once the Order has been received, D-Palm will send the Customer an email confirming receipt of the Order, containing the order number and details of the Order made ("Order Confirmation").

2.4 Subsequently, D-Palm will confirm to the Customer that the Order is being shipped ("Shipment Confirmation"), with timing depending on the type of shipment selected by the Customer.

2.5 The Customer must keep the order number on the Order Confirmation to access after-sales assistance and for any other communications with D-Palm.

3. Product Availability

3.1 The Customer may purchase a maximum number of three items of the same size per product.

3.2 D-Palm constantly monitors and updates the stock availability of products displayed on the Website. However, since the Website may be visited simultaneously by various customers, it is possible that more than one customer may intend to purchase or purchase the same product at the same time. In such cases, the product may appear available for a short time while actually out of stock or no longer available. If a product is unavailable, D-Palm will contact the Customer promptly and within five business days.

4. Purchase Procedure

4.1 To purchase a product through the Website, the Customer may create and/or access their account through the reserved area on the Website or place the Order as a guest without creating an account ("Guest" mode). If the Customer makes a "Guest" purchase, they must correctly fill in the fields of the relevant form on the Website, entering all the required data.

4.2 The description and essential characteristics of the products, including details, composition, fit, colors, and sizes (where applicable), are presented on the Website within each product sheet. Although D-Palm takes measures to ensure that the photographs shown on the Website are faithful reproductions of the original products, the images and colors may not be perfectly representative due to browser and/or device variations. D-Palm is not liable for any inconsistency of the graphic representations of the products shown on the Website due to these technical reasons.

4.3 D-Palm reserves the right to remove any product from the Website at any time for commercial reasons relating to the seasonality of the products.

4.4 To send an Order, the Customer selects the products they are interested in on the Website and places them in the virtual shopping cart.

4.5 Before completing the purchase, the Customer must check that the contents of the shopping cart are correct and enter any promotional code in the appropriate section. The promotional code, if valid, will be immediately applied to the amount displayed in the shopping cart. The Customer will then be asked to select the payment method, indicate the billing address, select the chosen shipping method, and specify the shipping address if different from the billing address.

4.6 By placing the Order and clicking on "Pay Now," the Customer expressly acknowledges and accepts the payment obligation. After placing the Order, the price of the product will be charged to the Customer through the selected payment method.

5. Price and Payment Methods

5.1 The price of the products indicated on the Website (the "Price") is inclusive of all applicable taxes and charges. Shipping costs are also included in the Price unless otherwise indicated on the Website and communicated to the Customer at checkout.

5.2 D-Palm reserves the right to change the Price at any time, without prejudice to orders already placed and agreements already entered into.

5.3 The payment methods available to the Customer depend on the country and may include:

5.4 The payment service is operated by a third-party payment provider. During the payment procedure, additional payment authentication may be requested by the card issuer or banking institution. D-Palm cannot be held liable for payment errors through the third-party payment service due to lack of connection or for any damages resulting from suspensions or interruptions in the operation of the bank’s website.

5.5 D-Palm will perform a standard pre-authorization on the payment method selected by the Customer. If it is not possible to charge the Price, the purchase process will be automatically canceled, and the Order will not be sent to D-Palm. In this case, D-Palm will have no delivery obligation towards the Customer.

5.6 The invoice or tax document relating to the purchase of the products will be sent by email to the Customer by the third-party payment provider.

5.7 Klarna provides the option of paying in three installments without interest. Payments for each installment will be automatically charged to the Customer with the selected payment method. More information on the terms and conditions for using the payment installment service offered by Klarna can be found on their website.

6. Shipping and Delivery

6.1 The purchased products are delivered to the Customer by shipment to the delivery address indicated in the Order.

6.2 Shipping costs and times depend on the type of shipment selected by the Customer during the purchase process. The types of shipping available vary from area to area.

6.3 The delivery times indicated on the Website are purely indicative, and delivery will be made within 30 days from the conclusion of the Agreement. After receiving shipment confirmation, the Customer can monitor the status of the shipment from the reserved area on the Website and/or the courier’s website with the shipment tracking number provided in the shipment confirmation.

6.4 Upon delivery of the products by the courier, the Customer must verify that the recipient’s details on the delivery receipt are correct and that the packaging and seals are intact.

6.5 Any damage to the packaging, altered seals, and/or discrepancies with respect to the recipient’s references or documentation must be immediately indicated in writing on the courier’s delivery receipt.

6.6 Orders consisting of several products may be delivered in several shipments.

7. Risks and Ownership

7.1 Ownership of the products is transferred to the Customer upon payment of the Price and shipping costs, while the risk of loss or damage remains with D-Palm or the courier until the products have been delivered.

8. Customization and Pre-Orders

8.1 D-Palm offers the possibility of customizing products and pre-ordering products not yet in stock.

8.2 When using the customization service, the Customer can choose how to customize the product by selecting options available on the Website. Customization is subject to limits predetermined by D-Palm.

8.3 The customization chosen by the Customer is saved for the current session only. If a session is interrupted before the Order is sent, the Customer will have to start a new session to customize the product.

8.4 Products not yet available in stock can be pre-ordered on the Website. Pre-ordering consists of booking the purchase of products being produced and/or delivered to the warehouse. After a pre-order has been sent, D-Palm will notify the Customer when the pre-ordered product is available and provide details of the shipping and delivery schedule.

8.5 If a pre-ordered product is unavailable, D-Palm will contact the Customer and refund the full Price paid without undue delay.

9. Warranty

9.1 Products purchased through the Website are covered by the legal warranty of conformity pursuant to applicable consumer legislation.

9.2 D-Palm shall deliver products that are in conformity with the Agreement. In case of defective or non-conforming products, the Customer must notify D-Palm promptly by filling in the relevant form available on the Website.

9.3 Non-conformities materializing within 12 months from the delivery date are assumed to have existed since that date unless proven otherwise.

9.4 The warranty is valid for two years from the product delivery date.

9.5 If D-Palm finds that a product is defective or non-conforming, the Customer may request repair or replacement. If neither repair nor replacement is possible, the Customer will be entitled to a refund.

10. Returns and Right of Withdrawal

10.1 The Customer may withdraw from the Agreement without any reason within 30 days of receiving the purchased products, using the procedure indicated on the Website.

10.2 The right of withdrawal does not apply to customized products, sealed products unsealed after delivery, or products likely to deteriorate or expire quickly.

10.3 To exercise the right of withdrawal, the Customer must inform D-Palm of their decision by sending a written communication within the period indicated above. The communication must include the Customer's order number and product details.

10.4 The Customer must return the products to D-Palm within 14 days from the date they communicated the decision to withdraw. Products must be returned in their original condition and packaging.

10.5 D-Palm will reimburse the Price and standard shipping costs within 14 days from receiving the returned products, using the same payment method used for the purchase unless otherwise agreed with the Customer.

10.6 D-Palm may withhold reimbursement until receiving the returned products or proof of return by the Customer.

11.1 The personal data provided by the Customer is processed in compliance with applicable data protection laws and D-Palm’s Privacy Policy, which can be consulted on the Website.

12. Governing Law and Jurisdiction
